Terms and Conditions

§ 1 Scope, customer information

The following General Terms and Conditions (T&C) govern the contractual relationship between Anton Doll Holzmanufaktur GmbH, Lilienstr. 3-5, 81669 Munich, and its customers. Conflicting terms or terms deviating from our General Terms and Conditions are not recognized by us. The language of the contract is German.

§ 2 Conclusion of contract

All offers are non-binding and subject to change. By completing the purchase process in the online shop, the customer submits a legally binding purchase offer. A purchase contract is only concluded upon written order confirmation. In the case of online orders, you will receive a corresponding confirmation by email.

§ 3 Customer information: storage of the contract text

Your order, together with details of the concluded contract (e.g. type of product, price, etc.), is stored by us. We will send you the T&C, but you may also access them at any time after conclusion of the contract via our website. As a registered customer, you can access your past orders via the customer login area (customer account).

§ 4 Customer information: correction guidance

Before completing the order, you can correct your entries at any time using the delete/return key. Closing the browser window before completing the order cancels the ordering process.

§ 5 Retention of title

The purchased item remains the property of Anton Doll Holzmanufaktur GmbH until full payment has been made.

§ 6 Statutory warranty rights for defects

Upon receipt of the goods, the customer is obliged to promptly inspect them for condition and quantity. Any complaints must be reported immediately, but no later than within 2 days, in writing. Justified defects will be remedied by repair, replacement delivery or price reduction. The choice of the appropriate remedy is ours. Minor material-related deviations in color, shape and size do not constitute grounds for a complaint. Statutory warranty rights for defects apply to our goods.

§ 7 Limitation of liability

We exclude liability for slightly negligent breaches of duty, provided these do not concern material contractual obligations, damages resulting from injury to life, body or health, guarantees, or claims under the Product Liability Act (ProdHaftG). The same applies to breaches of duty by our vicarious agents and our legal representatives. Material contractual obligations include, in particular, the obligation to hand over the item to you and to transfer ownership of it to you. Furthermore, we must provide you with an item free of material and legal defects.

§ 8 Consumer information: participation in janoFair

We participate in janoFair. janoFair is an alternative to the state-recognized consumer arbitration boards. If we are unable to settle disputes arising from our contractual relationship amicably, you as a customer may use janoFair's free dispute resolution procedure. The statute of limitations for any claims is suspended for the duration of this procedure. Should no agreement be reached there either, legal recourse remains available.

§ 9 Nature of the products

We use exclusively high-quality solid wood for our products. Knot holes, differently pronounced grain patterns, as well as variations in structure and color are characteristic properties of this natural product. They are among the typical characteristics of wood, and therefore color and structure deviations, even with identical surface treatment, must be accepted within the scope of natural wood properties and cannot be regarded as grounds for a complaint.

Production-related dimensional deviations of up to 2% are in accordance with the standard. Cracks that are not on the usage side and do not impair functionality, as well as hairline cracks up to a width of 1-2 mm on the usage surface, are excluded from complaints. Provided that safety and functionality are not compromised, this also applies to the bowing of panels. We work in accordance with the quality and testing standards of the German Furniture Quality Association (Deutsche Gütergemeinschaft Möbel e. V.) under RAL-GZ 430. Wood is a living natural product that can continue to change over time. Darkening as well as shrinking/swelling and the formation of cracks are not defects, but material properties that must be accepted.

§ 10 Delivery terms

Delivery times are stated according to our anticipated delivery capabilities. Anton Doll Holzmanufaktur takes care to observe delivery times but assumes no liability for the stated deadlines. This applies in particular to delivery delays for which the parcel service provider or freight forwarder is responsible. In the case of freight forwarder deliveries, specific delivery dates must be arranged exclusively with the freight forwarder. There is no entitlement to scheduling by Anton Doll Holzmanufaktur. Partial deliveries are permitted. Circumstances beyond our control that make delivery of the goods impossible entitle us to withdraw from the purchase contract. Within Germany and other European countries, delivery is "free domicile": Anton Doll Holzmanufaktur covers the delivery costs for freight forwarder deliveries and parcel shipping.

Delivery for parcel-shippable products is via DHL. Freight forwarder goods are, in principle, unless otherwise agreed, delivered kerbside. Deviating arrangements must be expressly agreed before delivery. For DUO deliveries by the freight forwarder to the place of use, the customer bears the proportional additional costs. Deliveries to France are excluded from this; here, freight forwarder delivery is generally carried out as a DUO delivery to the domicile, unless otherwise agreed. Delivery of freight forwarder goods is in all cases carried out by a service provider selected by us. Anton Doll Holzmanufaktur cannot assume liability for delivery delays for which the commissioned freight forwarder is responsible.

§ 11 Terms of payment

Prices include statutory value-added tax. Customers residing in Germany can choose between various common payment methods, including purchase on account, provided the credit check by our payment service provider Payone is positive. The data required for the credit check will be transmitted to Payone for this purpose. The payment term is within 14 days of receipt of goods. Deviating payment terms may only be agreed with us in writing. In the event of a negative credit report, purchase on account is excluded. For custom-made items, the full amount must be paid in advance. The order will only be processed after receipt of payment. Customers residing outside Germany are not entitled to purchase on account. In the event of default in payment, following an unsuccessful reminder, the collection of the claim will be handed over to a debt collection agency. The customer data required for this purpose will be transmitted accordingly. All costs and collection fees arising from the reminder procedure shall be borne by the debtor and will be invoiced to them in full.

§ 12 Choice of law and jurisdiction

German law applies to contracts with Anton Doll Holzmanufaktur GmbH, excluding the provisions of private international law and the UN Convention on Contracts for the International Sale of Goods. For all disputes arising from the contract with Anton Doll Holzmanufaktur, unless otherwise mandatorily required by law, Munich is agreed as the place of jurisdiction.

§ 13 PRIVACY POLICY

General information

We process your personal data (e.g. title, name, date of birth, address, email address, phone number, bank details, credit card number) only in accordance with the provisions of German data protection law. The following provisions inform you about the type, scope and purpose of the collection, processing and use of personal data. This privacy policy applies only to our websites. If you are redirected to other sites via links on our pages, please inform yourself there about how your data is handled.

Contract data

Your personal data, insofar as it is necessary for establishing, defining the content of, or amending the contractual relationship (contract data), is used exclusively for the performance of the contract. For example, your name and address must be passed on to the shipping service provider for the delivery of goods. In the case of purchase on account, this data is transmitted, in whole or in part, to the payment service provider Payone for the purpose of a credit check. Without your express consent or without a legal basis, your personal data will not be passed on to third parties outside the scope of contract performance. After the contract has been fully performed, your data is blocked from further use. This data is deleted after the tax and commercial retention periods have expired, unless you have expressly consented to its further use.

Comments

You have the option of writing a comment. For this we request some data (e.g. name/pseudonym, email address, website), which we use exclusively for the comment function. Without your express consent, this data will not be used for any other purpose and will not be passed on to third parties.

Web analytics with Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files stored on your computer that enable an analysis of your use of the website. The information generated by the cookie about your use of this website is generally transmitted to and stored on a Google server in the USA. This serves to safeguard our predominant legitimate interests in the optimal marketing of our offering as part of a balancing of interests. The Trustbadge and the services advertised with it are offered by Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne. § 14 Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise your right of withdrawal, you must inform us (Anton Doll Holzmanufaktur GmbH, Lilienstr. 3-5, Munich, kontakt@antondoll.de, phone: 08941616366) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). A sample withdrawal form is available at https://www.antondoll.de/widerrufsbelehrung, which you may use for this purpose. To meet the withdrawal deadline, it is sufficient for you to send your notice of exercising your right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and, in any event, no later than thirty days from the day on which we receive notice of your withdrawal from this contract. We will use the same means of payment that you used for the initial transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back, or until you have provided proof of having returned the goods, whichever is earlier. You must return the goods to us without undue delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal

Under § 312g (2) no. 1 of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive, or that are clearly tailored to the consumer's personal needs.

§ 15 Creditreform Boniversum information under Art. 14 GDPR

Our company regularly checks your creditworthiness when concluding contracts and, in certain cases where a legitimate interest exists, also for existing customers. For this purpose, we work with Creditreform Boniversum GmbH, Hammfelddamm 13, 41460 Neuss, from whom we obtain the data required for this. On behalf of Creditreform Boniversum, we provide you in advance with the following information pursuant to Art. 14 GDPR:

Creditreform Boniversum GmbH is a consumer credit reporting agency. It operates a database in which creditworthiness information about private individuals is stored.

On this basis, Creditreform Boniversum provides credit reports to its customers. Customers include, for example, credit institutions, leasing companies, insurance companies, telecommunications companies, receivables management companies, mail-order, wholesale and retail companies, as well as other companies that supply goods or provide services. Within the scope of statutory provisions, part of the data available in the credit reporting database is also used to supply other company databases, including for address trading purposes.

The Creditreform Boniversum database stores, in particular, information on the name, address, date of birth, where applicable email address, payment behavior and shareholdings of individuals. The purpose of processing the stored data is to provide information on the creditworthiness of the person concerned. The legal basis for the processing is Art. 6(1)(f) GDPR. Information about this data may only be provided if a customer credibly demonstrates a legitimate interest in knowing this information. The data is stored for as long as its knowledge is necessary for fulfilling the purpose of storage. As a rule, such knowledge is necessary for a storage period of initially three years. After this period expires, it is checked whether continued storage is still necessary; otherwise the data is deleted on the exact date. In the event that a matter is resolved, the data is deleted on the exact date three years after resolution. Entries in the debtor register are deleted on the exact date after three years have elapsed since the date of the registration order, pursuant to § 882e of the German Code of Civil Procedure (ZPO). Legitimate interests within the meaning of Art. 6(1)(f) GDPR may include: credit decisions, business initiation, shareholdings, claims, credit checks, insurance contracts, enforcement information.

You have the right vis-à-vis Creditreform Boniversum GmbH to information about the data stored there concerning you. Insofar as the data stored about you is incorrect, you have a right to correction or deletion. If it cannot be immediately determined whether the data is incorrect or correct, you have a right to have the respective data blocked until the matter is clarified. If your data is incomplete, you may request its completion.

Insofar as you have given your consent to the processing of data stored at Creditreform Boniversum, you have the right to revoke this consent at any time. The revocation does not affect the lawfulness of the processing of your data carried out on the basis of your consent up to the point of revocation.

Should you have any objections, requests or complaints regarding data protection, you may contact Creditreform Boniversum's data protection officer at any time. They will assist you quickly and confidentially with all data protection matters. You may lodge a complaint about a suspected data protection violation with a state data protection supervisory authority. To describe your creditworthiness, Creditreform Boniversum calculates a score value based on your data. The score value takes into account data on age and gender, address data and, in part, payment experience data. This data is factored into the score calculation with varying weightings. Creditreform Boniversum's customers use the score values as an aid in making their own credit decisions.

Right to object:

Under Art. 21(1) GDPR, you may object to the processing of data for reasons arising from your particular situation (e.g. women's shelter or witness protection).
